Your Rights as an Australian Employee

Australian workers are protected by comprehensive employment laws. Here are your fundamental rights.

All employees covered by an award must be paid at least the minimum rate specified.

Right to Penalty Rates

If you work outside standard hours (evenings, weekends, public holidays), you’re entitled to penalty rates.

Right to Payslips

Employers must provide detailed payslips within one working day of payday.

Right to Superannuation

Most employees are entitled to super contributions (currently 11.5% of ordinary earnings).

Right to Leave

Full-time and part-time employees are entitled to:

  • Annual leave
  • Personal/carer’s leave
  • Long service leave
  • Parental leave

Protection from Unfair Dismissal

You cannot be fired for raising pay concerns or exercising your workplace rights.

How to Exercise Your Rights

  1. Know your award
  2. Keep accurate records
  3. Request payslips
  4. Speak up about concerns
